When Will We Find a Member of Congress to Speak for Our Progressive Majority?; James O’Toole / Pittsburgh Post-Gazette; Progressive Democrats of America – PA 12th CD Chapter; April 27, 2013.

The title of the referenced piece is “Pennsylvania voters favor stricter background checks, poll finds.”  Even ignoring the fact there is no “Progressive Majority,” the BCR title seems odd given the original title and content of the PG article.

It appears the folks at BCR may have done a little editing of a piece presented as a product of the Pittsburgh Post-Gazette.  At the top of the piece as presented by BCR, there’s a photo with the caption, “Anyone can buy any gun at a PA Gun Show, no questions asked. Just plunk your money down.”  Neither the photo nor the caption appears in the online version of the PG piece.  I don’t know about the print version.

Regardless of who supplied the caption, it is false.  Pennsylvania requires state-licensed sellers to perform background checks using the Pennsylvania Instant Check System operated by the Pennsylvania State Police.  Depending on the firearm, private sellers must use a licensed dealer to make a sale and the dealer must perform a background check as he would if he were the seller.  PA gun laws apply whether you buy a firearm at a local dealer, at a gun show, or from your neighbor.

Update: Carl Davidson commented about this piece on his personal Facebook page: “You’re partly right, PA requires checks on hand guns at gun shows, but not long guns. My error, thanks for catching it.” Mr. Davidson then cited an excerpt from a Wikipedia article entitled “Gun shows in the United States.” 

Contrary to Mr. Davidson’s assertion, I am right, not “partly right.”  For whatever reason, BCR apparently wants readers to believe PA gun shows operate under a subset of PA’s gun laws.

I should note Mr. Davidson’s comment appears to have disappeared, though it could be pilot error on my part.  In any case, Mr. Davidson did not correct his article on either of the BCR websites (here and here) as of the date/time I posted this update.
