Almost exactly a year ago to the day, the Times published “Punishing language” about this very case. That editorial concluded with “Will they [the five conservative members of the court] protect First Amendment rights or curtail them? It matters.” The five non-lefty justices voted 4-1 (including Chief Justice John Roberts) in favor of Westboro. You’ll note this editorial made no mention of this aspect of the ruling. I guess “It matters” only when things go as the Times expects (hopes?).
