Government should revoke patent of drug company; David Hapach (DH); Beaver County Times; September 13, 2016.

Below is a detailed critique of the subject letter.


“I believe in response to Mylan Pharmaceuticals raising the price of the EpiPen, an already developed drug, many times the previous market price, the federal government should take their patent that they bought from another company by eminent domain and license it to a company that will make it at a fair price.”

[RWC] The above sentence as written is a little confusing.  I think this rewording is less confusing: “the federal government should take by eminent domain Mylan’s patent bought from another company …”

How does DH define “market price?”

Who determines what “a fair price” is?

“This would discourage a trend in the drug industry of buying up patents for common drugs and raising the price many tines [sic] the current market price.”

[RWC] DH believes government’s role is to punish businesses that don’t operate as he would like.

While I disagree with Mylan’s action, I would not remove their right to do it.  Where do you stop once you establish precedent?
